You’re on a journey to understand your body in a deeper, data-informed way. These terms help establish the ground rules for that journey, ensuring it’s clear, safe, and based on mutual respect. The Biongine platform, including all related content, features, data processing, services, and user interfaces, as well as any associated websites, software, or apps operated by Biongine Sp. z o.o. or its affiliates (“Biongine,” “we,” or “us”), is collectively called the “Services.”

We kindly ask that you take the time and read these Terms of Service carefully before using the Biongine platform and services.

By accessing or using our services, you confirm that you’ve read and accepted these Terms of Service. If you don’t agree with them, please don’t use the platform.

Any personal information that we collect through your use of the Services is processed in accordance with the Biongine Privacy Policy, which is incorporated into and forms an integral part of these Terms of Service.

If you do not agree with these Terms or the Privacy Policy, you must immediately discontinue all use of the Services, refrain from further access, and delete any downloaded materials related to the Services from your device(s).

Biongine Sp. z o.o. (or Biongine Ltd., depending on jurisdiction) operates the website at [www.biongine.com] and may also oversee affiliated subdomains, mobile apps, and integrations (collectively referred to as the “Platform”). Your use of the Platform and any content available through it, including visualizations, dashboards, downloadable reports, lifestyle suggestions, and other tools (collectively the “Content”), is governed by these Terms of Service (“Terms” or “Agreement”).

Although the Platform may be accessible globally, its intended use is limited to users residing in the European Union, the United Kingdom, and other jurisdictions where the Services may lawfully be offered.

Please read these Terms carefully, as they explain your rights, responsibilities, and legal obligations. In this Agreement, the terms “you” and “your” refer to any person who accesses or uses the Services.

THE SERVICES ARE NOT SUITABLE FOR USE IN EMERGENCY MEDICAL SITUATIONS OR FOR ADDRESSING ACUTE HEALTH CONDITIONS. IF YOU BELIEVE YOU MAY BE EXPERIENCING A MEDICAL EMERGENCY, IMMEDIATELY CONTACT A LICENSED PHYSICIAN OR CALL EMERGENCY SERVICES IN YOUR COUNTRY.

Biongine is not a healthcare provider or medical service. It is a technology platform that enables users to upload and visualize biological data for lifestyle monitoring and educational purposes. The Platform does not provide medical advice, clinical consultations, diagnostic services, treatment, or any other form of healthcare provision. All content, features, tools, visualizations, recommendations, and reports made available through the Platform are for informational and educational purposes only and are not intended as a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare professional. 

No clinical interpretation or diagnostic use. The Platform does not interpret laboratory results in a clinical or diagnostic context and does not provide risk assessments or clinical decision support. Any visualizations or trends presented are not intended to reflect medical standards, normal ranges, or clinical judgments. The “optimal ranges” displayed in the Platform are non-clinical reference zones and are not equivalent to medical diagnostic criteria.

No provider–patient relationship. Using the Platform, generating reports, or receiving lifestyle-related suggestions does not establish a provider–patient relationship between you and Biongine or any affiliated person or entity. Biongine is not a clinic, telemedicine service, or healthcare institution.

Third-party services and responsibility. Biongine does not control, monitor, or verify any medical advice provided by external healthcare professionals with whom you choose to share your data. It is not affiliated with or responsible for any laboratory, doctor, or third-party service involved in generating or interpreting your biological data.

User responsibility and independent healthcare judgment. You are solely responsible for making decisions about your health and well-being. Do not delay or disregard professional medical advice based on any content, data presentation, or recommendation from the Platform. If you have health concerns, abnormal test results, or symptoms, promptly consult a licensed healthcare professional. You are also accountable for evaluating the accuracy, appropriateness, and implications of any interpretation of your own data. Biongine does not verify the authenticity, completeness, or clinical significance of uploaded laboratory results, wearable device data, or other information you provide. 

Biongine does not offer any form of:

  • Preventive or curative diagnosis;
  • Risk stratification or medical monitoring;
  • Interpretation of symptoms or prescription guidance.

The Biongine Platform, including all software, reports, dashboards, and recommendation engines, is not a medical device as defined under Regulation (EU) 2017/745 on Medical Devices (MDR) or UK MDR 2002, is not approved for medical use, and is not intended for any medical purpose. It is designed strictly for lifestyle monitoring and personal insight based on user‑provided data. Biongine makes no claims of clinical performance, diagnostic utility, or therapeutic impact. Any overlap with clinical software design is incidental and not intended for healthcare settings.

You should not ignore medical advice or delay seeking care based on your use of Biongine.

Any health-related content or recommendations available on the Platform, including reference values, educational texts, lifestyle suggestions, and statements regarding nutrients, physical activity, or sleep, are general in nature, non-individualized, and provided for informational purposes only. They are not tailored to your personal medical history, are not to be construed as medical or therapeutic advice, and should never replace the independent clinical judgment of a licensed healthcare professional. Users are encouraged to consult their healthcare provider before making any changes to their health routines.

1. Definitions

For the purposes of these Terms of Service (“Terms”), the following definitions apply:

  1. Platform – the web-based and/or mobile interface operated by Biongine, through which Users may access the Services, available at [insert URL] or via associated applications or APIs.
  2. Biongine, we, us, or our – refers to the company operating the Platform, its legal successors, affiliates, and authorized representatives.
  3. User, you, or your – means any individual who accesses, browses, uses, or registers an account on the Platform and accepts these Terms, either for personal use or on behalf of another individual with appropriate legal authority.
  4. Services – the non-clinical, educational, and lifestyle-oriented features offered via the Platform, may include:
    1. Import and aggregation of laboratory test results;
    2. Visualization of biological data in a non-diagnostic format;
    3. Storing of historical biomarkers and other physiological parameters;
    4. Generation of downloadable and shareable reports;
    5. Display of general, research-based lifestyle content and recommendations;
    6. Personal health data management tools, including integration of wearables and notes;
    7. Any other feature expressly identified as part of the Biongine platform, excluding regulated healthcare services.
  5. Data – any structured or unstructured health-related information provided by the User, including laboratory results, wearable data, personal notes, files, and metadata uploaded or connected to the Platform.
  6. Visualizations – non-clinical graphical representations of health-related Data, including charts, timelines, heatmaps, or scores, intended solely for educational and lifestyle optimization purposes.
  7. Report – a downloadable PDF document generated by the Platform, summarizing User-provided Data in a readable and visually accessible format. Reports do not constitute medical evaluations, diagnoses, or treatment plans.
  8. Recommendation(s) – general, research-informed insights regarding lifestyle areas such as nutrition, sleep, supplementation, and physical activity, based solely on published data and without reference to individual medical history or diagnosis. These are not medical or therapeutic instructions.
  9. Medical Device – as defined by Regulation (EU) 2017/745 (MDR), any instrument, apparatus, appliance, software, implant, reagent, material, or other article intended by the manufacturer to be used for medical purposes. For clarity: the Biongine Platform and its components are not intended as or marketed to be a medical device.
  10. Health Data – personal data concerning the physical or mental wellbeing of a natural person, including the provision of health care services, which reveals information about that person’s health status, as defined under the General Data Protection Regulation (GDPR). The Platform processes only such data as voluntarily provided by the User, and solely for non-medical, informational purposes.
  11. Third-Party Services – services, tools, content, laboratories, wearable devices, or other integrations operated by entities not controlled by Biongine, which may be optionally used in connection with the Platform under the User’s direction.
  12. Account – a secure, personal profile created by the User on the Platform, granting access to selected Services, including storage and viewing of Data, Reports, and other features as permitted by Biongine.

2. Eligibility and User Obligations

  1. Eligibility Criteria
    Access to the Platform and use of the Services is permitted only to individuals who:
    1. Are at least 18 years of age or have reached the age of majority in their jurisdiction;
    2. Possess full legal capacity to enter into binding agreements;
    3. Agree to comply fully with these Terms;
    4. Use the Platform for personal, non-commercial purposes only.
      By using the Platform, you represent and warrant that you meet all of the above eligibility criteria. If you do not meet these requirements, you must not use the Platform or the Services.
  2. User Account Obligations
    Users may be required to create a personal account (“Account”) to access certain features of the Platform. You agree to:
    1. Provide true, accurate, current, and complete information during registration and at all times thereafter;
    2. Keep your login credentials confidential and secure;
    3. Accept full responsibility for all activities that occur under your Account;
    4. Immediately notify us of any unauthorized access or suspected breach of security.
      Biongine reserves the right to suspend or terminate your Account at any time, with or without notice, if it believes you have violated these Terms or applicable laws.
  3. Lawful Use Only
    You agree to use the Platform and Services only for lawful purposes and in accordance with these Terms. Specifically, you shall not:
    1. Use the Platform in a manner that may qualify as the unauthorized practice of medicine or the development of diagnostic algorithms;
    2. Upload any false, misleading, harmful, unlawful, defamatory, or offensive content;
    3. Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity;
    4. Attempt to access data of other users or reverse-engineer, copy, or exploit the Platform’s functionality or design;
    5. Circumvent any technological measures intended to prevent or limit access to the Platform or Services;
    6. Use the Platform in any manner that could disable, overburden, damage, or impair its functioning.
  4. Health Data Integrity
    You are solely responsible for ensuring the accuracy and completeness of any laboratory results, wearable data, documents, or other information you upload or connect to the Platform. Biongine does not review or verify the authenticity or clinical validity of such information.
  5. Prohibited Users
    You may not use the Platform if:
    1. You are a competitor of Biongine using the Platform for research or commercial analysis;
    2. You are acting on behalf of an insurance provider, healthcare institution, or employer to assess another individual’s data;
    3. Your use of the Platform would violate any law or regulation applicable to you, including data privacy or medical advertising rules.
  6. Non-transferability
    Your Account is personal to you. You may not assign, sell, lease, or otherwise transfer your rights to use the Platform to any other person without Biongine’s prior written consent.

3. Description of Services

Biongine provides a set of digital tools that allow Users to collect, visualize, and reflect on their personal biological data. These Services are strictly for informational, educational, and self-optimization purposes and are not intended for medical use.

  1. Data Import and Aggregation
    Users may upload their laboratory test results to the Platform in various formats (e.g., PDF, image, or direct integration with a third-party laboratory). The Platform uses automated or semi-automated tools to extract and organize this data into a user-friendly format for personal use.
    1. Biongine does not alter or validate the accuracy of these results.
    2. No clinical interpretation is applied to uploaded data without User’s explicit authorization.
  2. Visual Representation of Data
    The Platform displays health-related metrics using dynamic charts, color-coded dashboards, and non-clinical indicators, including comparisons to general “optimal ranges” based on public research or population data.
    1. These visualizations are designed for educational insight only.
    2. “Optimal” ranges are not diagnostic or therapeutic standards and are not equivalent to medical reference intervals.
    3. Users are advised to consult healthcare professionals regarding any values of concern.
  3. Longitudinal Tracking
    Users can observe changes in their uploaded data over time.
    1. This function does not interpret trends as improvements or deteriorations in health.
    2. No risk stratification or medical assessment is provided.
    3. Timeline charts are for self-monitoring and awareness only.
  4. Report Generation
    Users may generate a downloadable PDF report summarizing their personal data, including visuals and neutral explanatory text.
    1. These reports are designed to support conversations with healthcare providers, not replace them.
    2. Reports do not contain medical recommendations or treatment plans.
  5. Lifestyle Recommendations (Educational)

    Based on certain categories of data, the Platform may surface general educational content and published findings from scientific literature. For example:

    “Studies have shown that individuals with low vitamin D levels may benefit from increased sun exposure or dietary adjustments. Please consult a medical professional for individualized advice.”

    1. Biongine does not suggest specific doses, brands, or treatment protocols.
    2. The content does not constitute medical advice, health coaching, or nutrition counseling.
    3. All recommendations are non-personalized, general and non-binding.
  6. Personal Health Record (Non-Certified)
    Users can organize their personal health information, including uploaded files, manually entered notes, and data from integrated wearable devices (e.g., heart rate, sleep, HRV, activity levels).
    1. This panel is not an electronic health record (EHR) as defined under EU or UK regulations.
    2. It is intended for private use and not integrated with public health systems such as P1 in Poland or NHS systems in the UK.
  7. Third-Party Integrations
    Where available, the Platform may offer connections to third-party services, such as wearable device APIs or laboratory accounts.
    1. Biongine acts only as a facilitator and does not guarantee the accuracy, availability, or completeness of third-party data.
    2. Users are solely responsible for authorizing and managing such integrations and the accuracy of transferred and/or uploaded data.
  8. AI Chatbot (Educational Conversational Assistant)
    The Platform may offer access to an AI-powered chatbot designed to assist Users with general questions about health optimization, biomarker trends, and use of the Platform.
    1. The chatbot uses generative artificial intelligence to generate automated responses based on User input.
    2. It is intended solely for educational and informational purposes, and does not constitute or replace medical advice.
    3. Responses may not reflect accurate, current, or applicable scientific or clinical information.
    4. The chatbot does not form part of a therapeutic, clinical, or diagnostic workflow.

4. Nature and Limitations of Services

  1. Informational Use Only
    The Biongine Platform and all associated Services are provided solely for informational, educational, and lifestyle-enhancement purposes. The Services are not designed to diagnose, prevent, monitor, treat, or alleviate any disease, condition, or physiological process, nor are they intended to provide medical, therapeutic, or nutritional advice.
  2. Not a Substitute for Professional Medical Care
    Nothing on the Platform constitutes medical advice, clinical evaluation, or a recommendation for or against any medical treatment. The Platform does not replace the role of qualified healthcare professionals.
    1. Users are strongly advised to consult a licensed physician or healthcare provider regarding any concerns related to laboratory results, health conditions, or lifestyle changes.
    2. The use of the Platform must not delay or replace appropriate medical consultation or emergency care.
  3. No Clinical Decision Support
    Biongine does not assist in clinical decision-making. The Platform does not:
    1. Provide alerts, flags, or interpretations suggesting risk or urgency;
    2. Assess laboratory results in relation to symptoms, diagnoses, or disease progression;
    3. Evaluate test results against clinical reference ranges for diagnostic use.
  4. No MDR-Regulated Functionality
    The Platform is not a medical device under Regulation (EU) 2017/745 (MDR), UK MDR 2002, or related legislation. It is not intended to:
    1. Provide information for making medical decisions by a physician or other health professional;
    2. Support or monitor vital physiological processes in a clinical context;
    3. Be used for prevention, prediction, prognosis, or surveillance of disease.
      Any similarities in interface or functionality to health apps or medical software are purely coincidental and serve lifestyle self-awareness only.
  5. Scientific Content Does Not Equal Clinical Validation

    Scientific publications or referenced studies included on the Platform serve educational and contextual purposes only. Biongine does not represent that such content is applicable to the individual User or validated for use in clinical care. The inclusion of scientific literature, references to biomarkers, or mentions of peer-reviewed findings does not equate to health advice or imply endorsement of any particular intervention.

  6. No Therapeutic or Nutritional Claims
    Where the Platform discusses nutrition, supplements, physical activity, or sleep, such content is:
    1. Based on generalized evidence or population-level studies;
    2. Presented without claims of therapeutic efficacy or individual benefit;
    3. Not intended to treat or manage any specific health condition;
    4. Lacking in dosage, prescription, or product-specific advice.
  7. Results May Be Incomplete or Distressing
    Users should be aware that laboratory results may contain unexpected, unclear, or potentially concerning values. The Platform does not filter, contextualize, or provide emotional or medical support in the interpretation of such values.
    1. Biongine accepts no responsibility for user interpretation or reaction to uploaded data.
    2. If you experience distress, anxiety, or concern from any data presented through the Platform, you should contact a healthcare professional immediately.
  8. Use of Generative AI Technologies
    Some Services, such as the AI Chatbot, incorporate third-party generative AI tools. These tools are not capable of understanding individual health circumstances and may generate unreliable, incomplete, or inaccurate responses. You acknowledge that use of AI-generated content carries inherent risks, and you are solely responsible for verifying any information presented via such features.

5. Account Creation and Management

  1. Account Registration
    To access certain features of the Platform, you may be required to create a personal user account (“Account”). By registering, you agree to:
    1. Provide complete, accurate, and up-to-date information during the registration process;
    2. Maintain and promptly update your information to ensure it remains accurate and current;
    3. Refrain from impersonating another individual or misrepresenting your affiliation with any person or organization.
  2. Account Credentials and Security
    You are responsible for maintaining the confidentiality of your login credentials, including your username and password. You agree to:
    1. Keep your credentials secure and not share them with any third party;
    2. Notify Biongine immediately if you suspect any unauthorized access or use of your Account;
    3. Accept full responsibility for all activities that occur under your Account, regardless of whether they are authorized by you.
      Biongine shall not be liable for any loss or damage arising from your failure to comply with these obligations. Biongine reserves the right to request the setup of a 2-factor authentication.
  3. One Account per User
    You may only create and maintain one active Account per individual. Creating multiple accounts for the same person is prohibited unless explicitly authorized by Biongine.
  4. Account Ownership and Non-Transferability
    Your Account is personal and non-transferable. You may not assign, sublicense, sell, or otherwise transfer your Account or any of your rights under these Terms to another person or entity without Biongine’s prior written consent.
  5. Account Activity and Use Restrictions
    You agree not to use your Account to:
    1. Circumvent geographic, legal, or regulatory restrictions;
    2. Access or use the Platform in violation of these Terms;
    3. Collect, scrape, or harvest any information from the Platform, including that of other users;
    4. Host or disseminate malicious content, code, or unauthorized automated tools (e.g., bots, scrapers, crawlers).
  6. Suspension and Termination of Access
    Biongine reserves the right to suspend, restrict, or terminate your Account and access to the Platform at any time, with or without notice, in the event of:
    1. Violation of these Terms;
    2. Conduct that may harm other users, third parties, or Biongine;
    3. Legal or regulatory reasons;
    4. Suspected fraudulent, abusive, or suspicious activity;
    5. Unfulfilled subscription payment. Bioengine reserves the right to notify the user of upcoming subscription payment 30 days before the payment due.
      Suspension or termination may include deletion of your data, reports, or content. You acknowledge that Biongine is not obligated to maintain or restore your Account or data once it has been terminated.
  7. Voluntary Account Closure
    You may close your Account and cease using the Platform at any time by contacting us at [insert support email address]. Upon closure:
    1. Your access to the Platform will cease;
    2. Biongine may, but is not required to, delete your stored data in accordance with applicable law and our Privacy Policy;
    3. Certain residual data may be retained for legal or compliance purposes, subject to your rights under applicable data protection laws.

6. AI Chatbot

  1. AI Chatbot Overview
    Biongine may offer access to a conversational assistant powered by generative artificial intelligence (“AI Chatbot”) as part of the Services. The AI Chatbot is designed to provide Users with educational content and general information related to lifestyle, health optimization, biomarkers, and use of the Biongine Platform.
    All questions, messages, or uploads you submit during your interaction with the AI Chatbot (“Submissions”) may be processed to generate automated responses (“Responses”).
  2. Technology and Data Processing
    Biongine’s AI Chatbot uses third-party generative AI technologies and large language models (“AI Tools”) to process your Submissions.
    By using the AI Chatbot, you consent to the processing of your input data (which may include Personal Data) by these AI Tools, for the purposes of:
    1. Generating Responses;
    2. Improving and evaluating system performance;
    3. Analyzing user behavior to enhance platform functionality;
    4. Training future AI systems (unless you opt out — see below).
      Your interactions may be stored and monitored in accordance with our [Privacy Policy] and applicable data protection laws, including the General Data Protection Regulation (GDPR). You have the right to opt out of your personal data being used for AI model training by contacting us at [insert contact email].
  3. Not Medical Advice

    THE AI CHATBOT DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

    The Responses you receive:

    1. Are automatically generated based on general information;
    2. May be incomplete, outdated, misleading, or inaccurate;
    3. Are not reviewed, validated, or customized by medical professionals;
    4. Are not a substitute for professional medical advice or clinical judgment.
      Always consult a licensed healthcare provider before making decisions related to your health, treatments, medications, or lifestyle based on any Response from the AI Chatbot.
  4. Limitations and Risk Warning
    You acknowledge and agree that:
    1. AI Chatbot responses may omit key considerations such as your medical history, lab context, allergies, or co-existing conditions;
    2. Using AI-generated content to guide health decisions may result in harm if relied upon inappropriately;
    3. Biongine does not guarantee the safety, accuracy, or relevance of any information provided through the AI Chatbot.

      You represent and warrant that you will not use the AI Chatbot for:
    4. Emergency care or acute medical needs;
    5. Mental health crisis intervention or suicide prevention;
    6. Diagnosis, treatment, or medication selection;
    7. Any decision where clinical accuracy is essential.
      If you experience a medical emergency or believe you may be experiencing a serious condition, you must immediately contact emergency services or your licensed healthcare provider. Do not rely on the AI Chatbot.

  5. No Provider-Patient Relationship
    Use of the AI Chatbot does not establish any form of provider-patient, therapeutic, or clinical relationship between you and Biongine or any affiliated entity.
    The Chatbot is provided exclusively as an educational tool, intended to support general understanding of biological concepts or wellness topics.
  6. AI Chat Content Ownership and Monitoring

    All Responses generated by the AI Chatbot are the intellectual property of Biongine. By submitting information to the Chatbot, you grant Biongine a license to use, store, process, and analyze those Submissions in accordance with our [Privacy Policy].

    Biongine reserves the right to review, audit, or delete chat logs to monitor for abuse, improve quality, and comply with legal obligations. Do not submit any confidential, sensitive, or identifying health information unless you fully understand the implications of doing so.

  7. Disclaimer of Warranties and Liability

    ALL RESPONSES GENERATED BY THE AI CHATBOT ARE PROVIDED “AS IS” AND “WITH ALL FAULTS.”
    Biongine makes no warranties, express or implied, about:

    1. The completeness, truthfulness, or usefulness of the Responses;
    2. The absence of errors, bias, or misleading guidance;
    3. The fitness of any Response for a particular health condition or context.

      Biongine shall not be liable for any direct, indirect, incidental, or consequential damages arising from or related to the use of the AI Chatbot.

7. Data Processing and Privacy

  1. Voluntary Data Submission
    The Platform enables Users to upload or connect personal health-related information, including but not limited to:
    1. Laboratory test results (e.g., blood panels, hormone levels);
    2. Data from wearables (e.g., heart rate, sleep, activity);
    3. Manually entered notes, files, or observations.
      Submission of such data is entirely voluntary, and Users retain full control over what they choose to upload or connect.
  2. Purpose of Data Processing
    All personal data collected through the Platform is processed exclusively for non-clinical, educational, and lifestyle-related purposes, such as:
    1. Structuring uploaded data into readable formats;
    2. Displaying blood marker levels over time;
    3. Enabling report generation for personal insight and discussion with third parties;
    4. Displaying general lifestyle recommendations.
      Biongine does not process data for medical diagnosis, care coordination, or public health reporting.

      AI Chatbot Submissions

      If you use the AI Chatbot, your messages and interactions may be processed by third-party AI systems under the direction of Biongine. Such interactions may be stored, analyzed, and, where permitted by law, used to improve the Platform. For more information, see our [Privacy Policy].

  3. No Clinical or Public Health System Integration

    Biongine is not a certified Electronic Health Record (EHR) system and does not interface with national or regional medical databases (such as the P1 platform in Poland or NHS systems in the UK).

    1. Data entered into the Platform does not become part of any formal medical record.
    2. The Platform is not suitable for storing, transmitting, or exchanging medical documentation required under healthcare or insurance regulations.
  4. Privacy and Legal Basis under GDPR
    Biongine processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and relevant local laws. The primary legal bases for processing include:
    1. User consent (Article 6(1)(a)) for uploading personal data voluntarily;
    2. Performance of a contract (Article 6(1)(b)) where Services are provided based on these Terms;
    3. Legitimate interest (Article 6(1)(f)) to improve and secure the Platform, provided such interests do not override User rights.
  5. Sensitive Data (Health Information)
    Some uploaded data may qualify as special category data under GDPR (e.g., health information). Biongine processes such data only upon your explicit consent, which you may withdraw at any time by deleting your Account or contacting us directly.
  6. Data Security and Access Control

    We implement appropriate technical and organizational measures to ensure the security and confidentiality of your data, including:

    1. Encrypted transmission (e.g., HTTPS);
    2. Role-based access control within our systems;
    3. Periodic security audits and data minimization.
  7. Third-Party Data Processors

    All content, features, functionality, and intellectual property available through the Biongine Platform, including but not limited to software, source code, designs, algorithms, interfaces, dashboards, text, graphics, data visualizations, reports, branding, and logos, are the exclusive property of Biongine or its licensors, and are protected by applicable intellectual property laws.

  2. License to Use
    Subject to your compliance with these Terms, Biongine grants you a personal, non-exclusive, non-transferable, revocable, limited license to access and use the Platform for personal, non-commercial purposes.
    1. This license does not include the right to sublicense, resell, distribute, copy, modify, or create derivative works based on the Platform or its content.
  3. Restrictions on Use

    You agree not to:

    1. Reproduce, duplicate, copy, sell, lease, rent, trade, or exploit any part of the Platform for commercial purposes;
    2. Modify, reverse-engineer, decompile, disassemble, or attempt to extract source code from the Platform;
    3. Frame, mirror, scrape, or data-mine the Platform or its contents;
    4. Use automated means (bots, spiders, crawlers) to access or interact with the Platform;

    3. To improve and test the functionality of the Platform (in anonymized or aggregated form only, where applicable).
  6. AI-Generated Responses

    Any content generated by Biongine’s AI tools, including chatbot responses, shall be considered Biongine Content under these Terms and is protected by applicable intellectual property laws. You may not copy, redistribute, or rely on this content for clinical or commercial use.

  7. Feedback and Suggestions

    If you submit feedback, ideas, or suggestions about the Platform (collectively, “Feedback”), you acknowledge that:

    1. Such submissions are voluntary and non-confidential;

10. Prohibited Conduct

To maintain a safe, lawful, and transparent environment, you agree not to use the Platform or any of its Services in any way that:

  1. Violates the Law or Regulatory Framework
    1. Breaches any applicable local, national, or international law or regulation, including those related to privacy, data protection, medical services, or consumer rights;
    2. Attempts to use the Platform in a way that may trigger regulation under medical device laws, including the EU Medical Device Regulation (MDR) or UK MDR, by repurposing Biongine’s services as diagnostic or therapeutic tools.
  2. Misrepresents Medical or Professional Claims
    1. Uses the Platform to offer, imply, or simulate professional medical advice, diagnoses, treatments, or consultations to third parties;
    2. Publishes or redistributes any Biongine content as if it were medically validated or approved for clinical use.
  3. Violates Intellectual Property or Confidentiality Rights
    1. Copies, reproduces, modifies, reverse-engineers, disassembles, or attempts to extract source code or proprietary elements from the Platform;
    2. Infringes upon the intellectual property rights of Biongine or any third party;
    3. Uses branding, logos, or content without express written consent.
  4. Engages in Fraudulent or Harmful Behavior
    1. Provides false, misleading, or incomplete information, including fake laboratory data or impersonation of another person;
    2. Uploads or transmits content that is harmful, defamatory, abusive, obscene, offensive, threatening, harassing, hateful, discriminatory, or otherwise objectionable;
    3. Attempts to gain unauthorized access to accounts, systems, or data belonging to Biongine or other users.
  5. Circumvents Platform Restrictions
    1. Creates multiple accounts to bypass feature restrictions or subscription requirements;
    2. Uses any automated system, such as bots or scripts, to interact with or extract data from the Platform;
    3. Attempts to disable, bypass, or tamper with Platform features, security controls, or service limitations.
  6. Misuses Uploaded Data or Reports
    1. Misrepresents the nature of Biongine-generated reports by sharing them as diagnostic evaluations;
    2. Shares or distributes other users’ data or reports without their explicit consent;
    3. Posts reports publicly in a misleading context (e.g., suggesting therapeutic or diagnostic value).
  7. Endangers Platform Integrity or Other Users
    1. Uploads viruses, malware, or any harmful code;
    2. Interferes with or disrupts the operation of the Platform, including denial-of-service attacks or attempts to probe, scan, or test vulnerabilities;
    3. Harasses, threatens, or impersonates other users or Biongine representatives.
  8. Violates Terms of Third-Party Integrations
    1. Uses connected laboratory or wearable APIs in breach of their own terms of service;
    2. Facilitates unlawful or unauthorized access to third-party systems via Biongine’s interfaces.

      Violations of this section may result in immediate suspension or termination of your account, removal of uploaded content, and notification to appropriate authorities. Biongine reserves the right to investigate and take legal action where necessary.

11. Disclaimers

  1. Informational Purpose Only
    The Platform and its Services, including any content, reports, visualizations, recommendations, or educational material provided through Biongine, are offered solely for informational and lifestyle-supportive purposes.

    1. No aspect of the Platform constitutes or should be interpreted as medical advice, diagnosis, treatment, or clinical judgment.
    2. All information provided is generic, non-individualized, and not tailored to your specific medical needs or conditions.
  2. No Medical Relationship
    Using the Platform does not establish any relationship between you and a physician, medical provider, or health institution. Biongine is not a licensed healthcare provider, and the Platform does not replace professional medical consultation.
    1. Users are solely responsible for discussing their health data and any health-related decisions with a qualified medical professional.
  3. Not a Medical Device
    The Platform is not a medical device and is not intended for medical use as defined under:

    1. Regulation (EU) 2017/745 on Medical Devices (MDR),
    2. UK MDR 2002 and associated UK law, or
    3. any other regulatory framework applicable to diagnostic or therapeutic tools.
      Any overlap in appearance or functionality with tools used in medical settings is purely incidental and intended for self-awareness, not clinical interpretation.
  4.  As-Is and As-Available Basis
    The Platform and all associated content are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied.
    To the fullest extent permitted by applicable law, Biongine disclaims:
    1. Any warranties of merchantability, fitness for a particular purpose, title, or non-infringement;
    2. Any guarantees regarding the accuracy, reliability, completeness, or timeliness of the content or data;
    3. Any responsibility for errors, omissions, or interruptions in service availability.
  5. No Guarantee of Outcomes
    Biongine makes no claims, promises, or guarantees about:

    1. Improvements in your health, well-being, longevity, or physical condition;
    2. The scientific accuracy, interpretation, or applicability of any insights shown;
    3. The effect of any behavior changes based on Platform recommendations.
      You are solely responsible for the use or non-use of the information provided.
  6. Third-Party Content and Integrations
    The Platform may incorporate or rely on third-party services, APIs, laboratories, wearable device integrations, or reference materials.

    1. Biongine makes no representations or warranties regarding the quality, accuracy, or compliance of these external services.
    2. Use of third-party tools is at your own risk and subject to their respective terms.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Biongine and its affiliates, officers, employees, contractors, partners, licensors, and agents (collectively, “Biongine Parties”) disclaim all liability for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

  • Loss of data, income, revenue, profits, business, opportunity, goodwill, or anticipated savings;
  • Personal injury, emotional distress, or health deterioration resulting from reliance on any aspect of the Platform;
  • Errors, inaccuracies, or omissions in uploaded or visualized data;
  • Decisions made or not made in response to Platform content or reports;
  • Downtime, service interruptions, connectivity issues, or data corruption;
  • Issues caused by third-party platforms, labs, wearables, or service providers used in connection with Biongine.
  1. Maximum Liability Cap
    In no event shall the aggregate liability of Biongine Parties arising out of or related to your use of the Platform exceed:
    1. The total amount paid by you for the Services in the 12 months preceding the event giving rise to liability; or
    2. €100 (or the local currency equivalent), if no payment has been made.
      This limitation applies regardless of the form of action, whether in contract, tort (including negligence), strict liability, product liability, or otherwise.
  2. Applicability of Limitations
    The above exclusions and limitations apply even if:
    1. A Biongine Party has been advised of the possibility of such damages;
    2. The remedy fails of its essential purpose;
    3. Losses arise from the acts or omissions of third parties integrated into the Platform.
      Some jurisdictions do not allow limitations on implied warranties or the exclusion of certain types of liability, so some of the above limitations may not apply to you. In such cases, the liability of Biongine Parties shall be limited to the maximum extent permitted by law.
  3. Assumption of Risk

    By using the Platform, you expressly acknowledge and accept the inherent risks of relying on non-medical, non-professional, and educational content to support your lifestyle or wellness decisions.
    You agree that any actions taken based on Platform output, reports, or suggestions are at your sole discretion and responsibility.

13. Indemnification

  1. User’s Obligation to Indemnify
    You agree to indemnify, defend, and hold harmless Biongine and its officers, directors, employees, contractors, partners, affiliates, licensors, and agents (“Indemnified Parties”) from and against any and all third-party claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees), arising out of or relating to:
    1. Your access to or use of the Platform or Services;
    2. Any content or data you upload, submit, or share through the Platform;
    3. Your violation of these Terms or any applicable law or regulation;
    4. Your breach of any representation or warranty in these Terms;
    5. Your misuse or misrepresentation of reports, insights, or educational recommendations provided by Biongine;
    6. Your interaction with third-party labs, wearable providers, or data services integrated through the Platform;
    7. Any claim that your use of the Platform caused harm to another person or entity.
  2. Biongine’s Right to Assume Defense

    We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such cases:

    1. You agree to cooperate fully with our defense of such claims;
    2. You may not settle any claim without our prior written consent if the settlement would impose any obligation on Biongine or affect our rights.

    Your indemnification obligations under this Section shall survive the termination of your account or your use of the Platform, and continue to apply to any claim arising from your prior use.

  1. Right to Modify
    Biongine reserves the right to update, modify, or replace these Terms at any time, in whole or in part, at its sole discretion. Such modifications may reflect:
    1. Legal or regulatory changes;
    2. Updates to the scope of Services;
    3. Enhancements to the Platform’s features or technical structure;
    4. Clarifications or improvements in language for better usability.
  2. Notification of Changes

    If we make material changes to these Terms, we will take reasonable steps to notify you through one and/or all the following means:

    1. Posting an updated version of the Terms on our Platform with a revised “Last Updated” date or similar;
    2. Sending a notification via email or through your user account (if applicable);
    3. Providing a pop-up or in-app message the next time you log in.
  3. User Acceptance of Revised Terms

    Your continued use of the Platform after any changes to these Terms constitutes your binding acceptance of the revised Terms.

    1. If you do not agree to the updated Terms, you must stop using the Platform and may request the deletion of your account and associated data.

    Unless otherwise specified, updated Terms shall take effect upon being posted to the Platform. It is your responsibility to regularly check for updates.

  1. Governing Law
    These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of:
    1. Poland, if your primary place of residence or the principal place of business of Biongine is in Poland;
    2. The United Kingdom, if your primary place of residence or the principal place of business of Biongine is in the United Kingdom;
    3. Or another applicable jurisdiction as specified in a supplemental agreement or platform-specific disclosure.
      This choice of law does not affect your rights under the mandatory consumer protection laws of your country of residence, where applicable under EU Regulation (EC) No 593/2008 (Rome I) or UK equivalent legislation.
  2. Jurisdiction and Venue

    You agree that any dispute, controversy, or claim arising under or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of: Warsaw, Poland, if governed by Polish law; or London, United Kingdom, if governed by UK law.

  3. Alternative Dispute Resolution (Optional)

    Before initiating formal legal proceedings, you agree to consider resolving the dispute amicably through a negotiation period of at least 30 days.
    Biongine may also offer access to voluntary alternative dispute resolution (ADR) mechanisms in accordance with the EU ODR Regulation (Regulation (EU) No 524/2013) or UK ADR schemes, where applicable.

  4. Injunctive and Equitable Relief
    Nothing in this section shall limit either party’s right to seek immediate injunctive relief, protective orders, or other equitable remedies from a court of competent jurisdiction in case of:
    1. Actual or threatened misuse of confidential information;
    2. Infringement of intellectual property rights;
    3. Other urgent or irreparable harm.
